Dans le cadre de la collecte des corpus oraux et multimodaux en Sciences Humaines et Sociales (SHS), le respect de l’application du nouveau Règlement Général sur la Protection des Données à caractère personnel provoque un profond bouleversement dans l’organisation et les méthodes de travail des chercheurs. C’est aussi le cas de la Loi Jardé, relative aux recherches impliquant la personne humaine, qui a étendu la notion de protection des personnes au-delà du champ de la recherche biomédicale. Ces deux importants changements (...) de cadre législatif obligent aujourd’hui la communauté scientifique à s’interroger à la fois sur la protection de la personne et sur la protection des données à caractère personnel.En définitive, avant d’initier un travail de recherche, un important travail de réflexion et d’actions est à mettre en place pour collecter des données dans le respect de la réglementation de protection des données et du cadre législatif de protection de la personne humaine. Identifier les difficultés pour envisager les solutions les plus adaptées est la mission que s’est fixée le groupe de réflexion constitué autour de la question « éthique » au Laboratoire Parole et Langage (LPL 2020). Nous proposerons dans cet article les réflexions argumentées de notre groupe sur l’impact de ces nouvelles réglementations sur les recherches en linguistique. (shrink)

There are striking structural similarities between Freud's ego and Kant's transcendental unity of apperception, which for Kant grounds our use of ‘I’ in ‘I think’. There are also striking similarities between Freud's superego and Kant's account of the mental structure that grounds our use of ‘I’ in the moral ‘I ought to’. The paper explores these similarities on three main points: the conflict of motivations internal to the mind, the relation between discursive and pre‐discursive representation of moral motivation, and the (...) unconscious character of moral motivation. The suggestion is that Freud offers resources for a naturalized account of just those features of our moral motivation that, according to Kant, seem to make it least amenable to a naturalistic explanation. How much of a revision of Kant's analysis of moral justification is thereby entailed is beyond the purview of the paper. (shrink)

Abstract1 June 2018 marked a historic moment in Spanish politics, when the Spanish Socialist Workers’ Party (Partido Socialista Obrero Español, PSOE) announced a cabinet with the largest proportion of female ministers in the world. This announcement received extensive coverage in the traditional media. The objective of this research was to measure whether the news had an equivalent impact on Twitter users. To this end, we analyzed the reaction to the appointments based on the popularity of the hashtags #GobiernoSanchez (“Sanchez Government”), (...) #GobiernoFeminista (“Feminist Government”) and #ConsejoMinistras (“Council of Female Ministers”). The most significant findings are that women had even less visibility than they were given in traditional media because of what is not retweeted does not exist, and that the extreme polarization of political life and the media in the public sphere appears to extend to the digital environment of Twitter. "Kant and the Capacity to Judge" will prove to be an important and influential event in Kant studies and in philosophy.

There has recently been work by multiple groups in extracting the properties associated with cardinal invariants of the continuum and translating these properties into similar analogous combinatorial properties of computational oracles. Each property yields a highness notion in the Turing degrees. In this paper we study the highness notions that result from the translation of the evasion number and its dual, the prediction number, as well as two versions of the rearrangement number. When translated appropriately, these yield four new highness (...) notions. We will define these new notions, show some of their basic properties and place them in the computability-theoretic version of Cichoń's diagram. (shrink)

From Leonardo Polo's philosophy it is possible to clarify the object and specific method of psychology, overcoming in this way the situation of the "problematic science". Its relation to anthropology and some sciences as physics, biology and ethics can also be investigated. To do so, Polo takes notions again from Aristotle's psychology and the contributions of cybernetics. A reflection of these characteristics allows us to rectify and extend the scientific possibilites of psychology, avoiding reductionisms and sincretisms.

This article aims to theoretically analyse so-called character friendship from the perspective of emotions. From this angle, our research enables us to distinguish different types of emotions, and we propose a conceptual model of the hierarchy of the emotions of character friendship and their influence on social behaviour. With this model in hand, the article discusses whether other-oriented emotions fully explain the emotional underpinnings of character friendship. We find other-oriented emotions to be ambiguous because they may or may not be (...) selfless. Thus we question whether these emotions can adequately explain the bonding content of character friendship. We conclude that there is a higher affective tier related to moral emotions and moral behaviour, which we have labelled the ‘bonding feeling’. This feeling is described with reference to its historical precedents (Rof Carballo’s ‘affective warp’), thus explaining its particularity. (shrink)

Jurisdiction, Scale and Governance: Chronotopes of Law develops a post-metaphysical framework for analyzing the spatio-temporal workings of law and other forms of governance. In this regard, it does not seek merely to combine analyses of legal temporality carried out by anthropologists with analyses of law and space carried out by geographers and socio-legal scholars. Adding two metaphysical abstractions together does not produce anything but somewhat more complex, but equally metaphysical, abstractions. Uno de los problemas omnipresentes en la teoría política es el de qué tipo de relación debe existir entre el régimen democrático en tanto sistema de toma de decisiones colectivas y las vidas de sus ciudadanos, en tanto seres dotados de fines, metas y deseos. Ya sea desde las concepciones que estipulan que las decisiones mayoritarias pueden poner en riesgo ciertos ideales de buena vida o desde aquellas que creen que el tipo de justificación de las decisiones políticas no puede (...) dar cuenta de los procesos hermenéuticos individuales de búsqueda de significado a la propia existencia hasta aquellas concepciones que consideran que las condiciones para la búsqueda de la buena vida no pueden quedar libradas al desigual poder social o las que consideran que el bienestar individual debe quedar restringido a su compatibilidad con una autocomprensión colectiva de una buena sociedad, la cuestión reaparece incluso cuando se pretende hacerla a un lado. Los textos que componen este Dossier ofrecen diferentes aristas de estos problemas, los cuales vienen siendo tratados extensa y prolíficamente en la obra de Graciela Vidiella. La versión seniana del enfoque de las capacidades define a la libertad individual en términos de la posesión de una preferencia decisiva. A través del análisis de la discusión con la definición provista por el republicanismo, se mostrará que la primera desconoce el papel que las instituciones deben jugar a la hora de proteger esas libertades y que, por lo tanto, es inadecuada. En este artículo se argumenta que, cuando esta definición es considerada dentro del marco más general del pensamiento (...) seniano, es posible hallar una solución a tales problemas, y que ella consiste en vincular las libertades con una concepción deliberativa de la democracia. Sin embargo, se mostrará que esta solución tiene costos teóricos y que parte de esa definición de la libertad o bien debe abandonarse o bien relativizarse. Senian Version of the Capability Approach defines individual freedom in terms of having a decisive preference. Through the analysis of the discussion with the definition provided by republican conceptions, it will be shown that Senian definition ignores the role that institutions should play at protecting those freedoms and that this is a reason to consider it inadequate. This article argues that, when this definition is considered in the more general framework of Senian thinking, a solution can be founded. This solution consists in the construction of a solid link between freedom as decisive preference and a deliberative conception of democracy. However, it will be argued that this solution has some theoretical costs and that part of that definition should be given up or at least relativized. (shrink)

We aim to map out the points of confluence between phronesis and emotion, as well as the nature of this confluence. We do so based on philosophical and psychological explanations of emotions and phronesis. Making sound decisions, which requires phronesis, is an important matter, but its relationship with emotions has only just begun to be studied. We propose that the interplay between phronesis and emotion is possible (rather than inevitable) because both have a cognitive-behavioural structure and because emotions are hierarchical. (...) In the case of emotion, there are no gaps between the cognitive and behavioural dimensions, while phronetic acts can only manifest if cognitive and behavioural aspects are activated simultaneously. The confluence we identify is bidirectional and involves mutual enrichment in this dual dimension. On the one hand, phronesis enriches emotion because it involves extra subjective knowledge and allows emotion to be directed towards higher goals. On the other hand, emotions enrich phronesis because phronesis makes decisions based on sensitive preferences and because emotions confirm correctness in the context of moral decision making. Methodologically, this study is theoretical and interdisciplinary, as our approach is both philosophical and psychological. Philosophy helps us to improve the conceptual foundation of the construct, while psychology provides an analysis of the emotional process, allowing philosophy to understand how emotional evaluation-assessment and motivation lead to decision making. Surveys were conducted at two metta meditation retreats in order to examine the psychological effects of metta meditation. Participants were invited to complete the survey at the beginning of the retreat, at the end of the retreat, and two weeks after the end of the retreat. Participants completed the same scales at each time phase, which included measures of happiness, compassionate love, revenge and avoidance motivation, gratitude, and a depression, anxiety and stress scale. Significant increases were found in happiness and (...) compassionate love, reductions in avoidance and revenge, and reductions on the depression, anxiety and stress subscales. (shrink)

Hegel's Science of Logic has received less attention than his Phenomenology of Spirit, but Hegel himself took it to be his highest philosophical achievement and the backbone of his system. Los últimos textos de Martha Nussbaum representan un esfuerzo por presentar una versión del enfoque de las capacidades que se enmarque dentro del liberalismo político rawlsiano. El objetivo de este artículo es mostrar que esta vinculación es defectuosa porque, en primer lugar, los desacuerdos morales profundos entre los ciudadanos son disueltos por medio de una petición de principio y porque, en segundo término, la estabilidad política no se halla suficientemente garantizada.Martha Nussbaum's latest works attempt to give a version of the (...) capability approach that could be consistent with rawlsian political liberalism. The main purpose of this article is to show that this connection is flawed because, first, the deep moral disagreement among citizens are dissolved by a petitio principii and, in second term, because political stability is not enough sustained. In this article I analyse different strategies of defence –derived from Hart´s PostScript– used by the legal positivists against the numerous objections made by Ronald Dworkin. Against the abandonment of the dispute proposed by Liam Murphy, I show that the methodological and conceptual discussion between Dworkin and legal positivism is vital for the dworkinian theoretical purposes.

El noûs poie-tikós de Aristóteles ha sido objeto de innumerables estudios y debates a lo largo de la historia de la filosofía. Este artículo trata sobre la visión que de él tiene el aristotélico renacentista P. Pomponazzi, célebre, entre otras cosas, por suscitar una agria polémica con su tesis de que la razón natural no ofrece argumentos que puedan sostener la inmortalidad del alma. Esta tesis tiene que dar respuesta, sin embargo, a aquellos textos aristotélicos que hablan de la inmaterialidad (...) e inmortalidad del intelecto. El autor estudia esta respuesta de Pomponazzi en el contexto de los elementos más importantes de su psicología. (shrink)

A partir de El Conocimiento del Amor, Martha Nussbaum emprendió un novedoso proyecto teórico, el de construir una vinculación productiva y no colonizadora entre la literatura y la reflexión moral. Una de las tesis que aúnan sus múltiples textos sobre este proyecto es que la lectura de textos literarios puede ser un componente no solo importante, sino necesario en el desarrollo moral de los sujetos. Por medio de una determinada forma de lectura y de un lector activo y crítico al (...) mismo tiempo, el sujeto podría desarrollar en mayor grado una capacidad empática que le permita reconocer injusticias, afectos y vulnerabilidades en situaciones allende la propia y en otros individuos (Nussbaum, 1997a, p. 111). El objetivo de esta presentación es contrastar esta tesis con un texto central de la literatura argentina moderna, El Juguete Rabioso2 de Roberto Arlt. Escritor, periodista e inventor, Roberto Arlt (1900-1942) es considerado como uno de los primeros escritores modernos de Argentina que incorporó materiales heterogéneos para su obra literaria –textos periodísticos, manuales químicos, etcetera– y que ofreció una interpretación particularísima de la vida urbana cambiante, desigual y políticamente movilizada de las primeras décadas del siglo XX. Construida como una novela de iniciación, el texto arltiano acompaña las desventuras existenciales de Silvio Astier, un joven marginado de los años 30 del siglo pasado que, a pesar de buscar el éxito a cada paso, solo encuentra el fracaso. El punto central de nuestro interés estará colocado en que el acto trascendental de su vida, una acción cruel y vil contra un amigo es llevada a cabo y justificada como producto de leer determinadas novelas literarias. La cuestión problemática de esta contrastación será cómo interpretar esta acción de Astier. ¿Es una refutación parcial de la tesis de Nussbaum, ya que las lecturas de Astier guían esta acción moralmente incorrecta?, ¿o es solo una advertencia contra las esperanzas exageradas de Nussbaum en la capacidad transformadora de la literatura?, ¿o, por el contrario, es una confirmación de la tesis, ya que esa acción no se seguiría del tipo específico de lectura que propone Nussbaum?, ¿o es, en este mismo sentido, una advertencia de que las condiciones capitalistas e individualistas representan obstáculos para el tipo de lectura que promueve Nussbaum?. En este artículo, defenderé que la interpretación más adecuada de la acción trascendental de Astier es que ella no surge de una experiencia lectora demasiado empática, sino de una experiencia lectora que rechaza la empatía, ya que implica la fusión total entre el personaje ficticio arltiano y aquellas novelas que conforman su experiencia literaria. La estructura del trabajo es la siguiente: En la primera sección, reconstruiré lo que Nussbaum denominó la promesa política de la literatura y cómo ella se basa en el mayor desarrollo de las capacidades empática y compasiva que puede ofrecer, en especial cuando se la compara con las teorías éticas generales tradicionales. En la segunda sección, confrontaré dos tipos de respuesta moralizante que la teoría de Nussbaum podría dar frente al “caso Astier” y mostraré que existe una respuesta no-moralizante y que refuerza la teoría de la filósofa. El igualitarismo de la suerte es una teoría de justicia distributiva que incluye consideraciones de responsabilidad atributiva individual para definir las obligaciones distributivas. Se presenta como un intento de recomponer cierta consistencia interna a la teoría rawlsiana y evitar algunas de sus consecuencias “inequitativas”. El artículo defiende la consistencia interna del proyecto rawlsiano sin necesidad de incluir un criterio sensible a la responsabilidad atributiva individual, ya que la inclusión de tal criterio resultaría ilegítima desde el punto de vista rawlsiano.

It is patently clear that theoretical difficulties in the understanding of human freedom exist, the roots of which can be found in classic psychological proposals. The western crisis may require reconsideration of freedom and responsibility as expressed in each person. One such proposal of this type begs clarification of the approaches that led to the loss of freedom in the existential horizon and thus of social dynamics. The purpose of this paper is to explain its roots in the psychoanalytic context. (...) Specifically there seems to be three theses that give way to this analysis: the role of the past in shaping the personality; the influence of the psychological workings as related to the handling of conflict as well as the understanding of psychoanalysis as hermeneutics. The three are united in the consideration of freedom as “liberation”, and the temporal dynamics implicit in this concept. We conclude that this is the origin of the limitation of the concept of freedom within psychoanalysis. (shrink)

Departing from Leibniz’s ontological argument, and specifically from the “possibility-complement” just as it appears in his texts, this article offers a detailed analysis of the very same concept of possibility. This is an attempt at showing its consistency in a very extreme metaphysical situation: the possibility of God without any reference to the world of possibility, contingency or eternal truths. The logic and real possibility, the merely possible, the relationship between possibility, compossibility and the Characteristic, are some of the questions (...) dealt with in this article. (shrink)

La creacion de una metapsicología, sustituta de la metafísica, como una suerte de hermenéutica, es el núcleo de las observaciones de Leonardo Polo. Sus apreciaciones muestran un profundo conocimiento del psicoanálisis y de sus limitaciones intrinsecas. Ofrece también, sugerencias para abordar el estudio de la psicología como una ciencia coherente con el contexto científico en el que se halla su objeto propio.
